WHAT IS A FAMILY DISPUTE RESOLUTION PRACTITIONER?

ARE ARESOLUTION’S PRACTITIONER’S ACCREDITED?
Yes. FDR practitioners must meet the accreditation standards in the Family Law Regulations 2008 with the Attorney General’s Department, to be able to provide parties a recognised mediation service. Without such qualifications, the parties will not be able to request a Certificate 60I to seek Parenting Orders.
FDR professionals are also required to be competent in being able to assess families for associated violence and child abuse. This is conducted at the Pre-Mediation Session which is an assessment as to whether mediation is suitable for each case.
FDR practitioners generally have a background in psychology and/or law. They do not replace the role of a counsellor or family lawyer, however, they can work within the paradigm of family law (to meet obligations already determined by the Family Law Act 1975) and have an understanding of human behaviour and how this affects people in conflict.
DO I HAVE TO SEE A RESOLUTION PRACTITIONER
FDR is a mandatory process to avoid the Family Court. Parties are encouraged to use this as an alternative method to be able to reach agreements in an amicable manner. This will help to prevent extensive legal costs, to minimise the time and hassle of Court, and more importantly, to alleviate stress on the individuals and any children involved.
In most circumstances, you can only apply to a Court for a parenting order when you have a certificate from an accredited FDR practitioner. There are some exemptions to this (e.g., if there is a risk of harm involved in the case), and you should contact an FDR practitioner, a Family lawyer, Legal Aid or the Family Court to see if these exemptions apply to your circumstances. The requirement to participate in FDR applies to new applications, and applications seeking changes to an existing parenting order.
